• Candidate screening via WhatsApp using AI technology

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Comply with all applicable laws and regulations, including employment laws
• Not discriminate against candidates based on protected characteristics
• Provide accurate information about job positions and requirements
• Respect the privacy and rights of candidates
• Not use the Service to send spam or unsolicited messages

5. WhatsApp Integration

Our Service integrates with WhatsApp Business API. By using this feature:

• You acknowledge that WhatsApp's terms of service also apply
• You consent to receiving messages via WhatsApp for screening purposes
• You understand that AI will be used to conduct screening conversations
• You agree that conversation data will be stored and processed as described in our Privacy Policy

6. AI-Powered Features

Our Service uses artificial intelligence for candidate screening and evaluation. You acknowledge that:

• AI-generated assessments are tools to assist decision-making, not final decisions
• Human review is mandatory for all hiring decisions. AI scores and assessments must not be used as the sole basis for any hiring decision
• Final hiring decisions must be made by a qualified human decision-maker who considers the AI assessment alongside other relevant factors
• AI responses may occasionally be inaccurate or incomplete
• We continuously work to improve AI accuracy and reduce bias

By using this Service, employers agree that they will not rely solely on AI-generated scores or assessments to make hiring, rejection, or any other employment decisions. Failure to ensure human oversight in hiring decisions constitutes a violation of these Terms.

7. Intellectual Property

All content, features, and functionality of the Service are owned by Presco and are protected by intellectual property laws. You may not copy, modify, or distribute our content without prior written consent.

8. Data Protection

We process personal data in accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia. Please refer to our Privacy Policy for details on how we collect, use, and protect your data.

9. Limitation of Liability

To the maximum extent permitted by law, Presco shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service, including but not limited to:

• Hiring decisions made based on AI assessments
• Loss of data or business interruption
• Unauthorized access to your account
• Any errors or inaccuracies in AI-generated content

10. Indemnification

You agree to indemnify and hold harmless Presco from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes by posting a notice on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
